In the state of Washington, alimony (or spousal support) is technically referred to by statute as spousal maintenance. The primary factor considered by the courts in determining the amount or issuance of an alimony award is the duration of a marriage. Other factors, including the disparity of income between spouses, will be considered by the court and used to determine whether an award of alimony is appropriate, and if so, how much should be awarded and for what duration of time.
There is no precise mathematical formula a person can use that will predict precisely how a court will decide in a particular case involving a claim for alimony/spousal maintenance. The best way to protect your rights if you are getting a divorce is to retain an experienced divorce lawyer who can perform a complete analysis of your case and use his or her knowledge of the law to make a persuasive argument in your favor.
As with any dispute in a divorce, disagreements over a request for alimony/spousal maintenance may be negotiated and may even be the subject of mediation.
